This legal notice applies to the entire contents of the Site under the domain namewww.toguuk.co.uk (Site) and to any correspondence by email between TOGU UK and you.

By accessing any part of the Site, you shall be deemed to have accepted this legal notice in full. If you do not accept this legal notice in full, you must leave the Site immediately. We may update this information, and you should check the Site from time to time to check how this information may relate to you.

1 LICENSE

1.1 You are permitted to print and download extracts from the TOGU UK Site (for personal use only) on the following basis:

1.1.1 no documents or related graphics on the TOGU UK Site may be modiﬁed in anyway:

1.1.2 no graphics from the Site may be used separately from the corresponding text;

1.1.3 the TOGU UK copyright and trade mark notices and this permission notice must appear in all copies.

1.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on the Site (including without limitation photographs and graphical images) are owned by TOGU UK or its licensors. If you breach any of the terms in this legal notice, your permission to use the Site automatically terminates and you must immediately destroy any downloaded or printed extracts from the Site.

1.3 No part of the TOGU UK Site may be reproduced or stored in any other Site or included in any public or private electronic retrieval system or service without TOGU UK’s prior written permission. Any rights not expressly granted in these terms are reserved.

2. SERVICE ACCESS

2.1 TOGU UK shall not be liable if for any reason the Site is unavailable at any timing for any period. However TOGU UK aim to ensure the Site is available 24 hours a day. In case of system failure, maintenance or repair or for reasons beyond TOGU UK’s control, access to the Site may be suspended temporarily.

3.1 Other than personally identiﬁable information, which is covered under our Private Policy, any material you disclose or post to the Site shall be considered non-conﬁdential andnon-proprietary. TOGU UK has no responsibility to the security of such material. TOGU UK is free to copy, disclose, distribute, incorporate and use such material and all data, images, sounds, text and other things embodied there in for any and all commercial or non commercial purposes. 3.2 You are not permitted to post any material that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inﬂammatory, blasphemous, in breach of conﬁdence, in breach of privacy or which may cause annoyance or inconvenience, or which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world or which is technically harmful (computer viruses, worms, logic bombs etc). 3.3 You may not misuse the Site. 3.4 TOGU UK shall fully co-operate with any law enforcement authorities or court order requesting or directing the company to disclose the identity or locate anyone posting any material in breach of section 3 in the Terms and Conditions.

4.1 The links provided on the Site are there purely for your convenience. You acknowledge that TOGU UK is not responsible for the operation of or content located on or through any such site. If you decide to access any third party Site linked to the TOGU UK Site, you do so entirely at your own risk.

5. DISCLAIMER

5.1 TOGU UK does not warrant the accuracy and completeness of the material on the Site, although TOGU UK seeks to ensure that the information on the Site is correct. TOGU UK will make changes to the material on the Site, or products and prices described in it, at anytime without notice. The material on the Site may be out of date and the company makes no commitment to update such material.

6. LIABILITY

6.1 All liability and responsibility for any amount or kind of loss or damage in connection with the Site in any way or in connection with the use, that may result to you or a third party is not that of TOGU UK or any of TOGU UK’s group members (employees, shareholders, agents etc) responsibility. Further, no warranty is given that the Site shall be available on an uninterrupted basis, and no liability can be accepted in respect of losses or damages arising out of such unavailability.

6.2 Nothing in this legal notice shall exclude:

6.2.1 Personal injury and death caused by our negligence;

6.2.2 fraud

6.2.3 any liability under the Consumer Protection Act 1987.

6.3 If your use of material on the Site results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.

7. LAW AND JURISDICTION

7.1 These terms will be governed by and construed in accordance with the laws of England and Wales. Disputes arising in relation to this Site or these terms shall be subject to the exclusive jurisdiction of the courts of England.
